THE 1ST AND MAYBE LAST LAWYER APPOINTMENT

OK ARE YOU READY?

IT WENT SOME THING LIKE THIS. WE GET THERE AND THEY CALLED US BACK TO A ROOM BEFORE WE COULD EVEN SIT DOWN THEY WERE LIKE OK ITS $150.00. I SAID OK KTRACHO PAY UP! THEN SHE GIVES US A COUPLE OF PAPER TO FILL OUT AND I FILLED THEM OUT! THEN 15 MIN LATER HERE COMES THE LAWYER! I SAID
1. HE CAME HERE FEB. 25, 1999, AT THAT TIME HE WAS 17 YEARS OLD
THEY GAVE HIM SOME PAPER AND A COURT DATE!
2. WE MET IN JULY 2004 AND HAD OUR DAUGHTER(Challo) JUNE 23, 2005, THEN WE GOT MARRIED 2 YEARS AFTER AND ALMOST 2 YEARS AFTER BEING MARRIED WE ARE READY TO FILE!

HE SAID OK LET ME GET MY PHONE, HE CALLED SOME # AND ON HIS PAPER THERE WAS AN A# HE BUT THAT # IN AND IT SAID AS OF JULY 13, 1999 HE WAS ORDER A DEPORTATION IN ABSENTEE I SAID OKAY! HE THEN SAID THAT OUR CASE IS VERY HARD VERY VERY DIFFICULT TO WIN. HE THEN STARTED TO SAY AS OF JULY 13, 1999 TIME FOR HIM HAS FROZEN! BECAUSE HE WAS ORDER A DEPORTATION IN ABSENTEE SO THE ALMOST 10 YEARS MIGHT NO COUNT! BUT BECAUSE HE WAS UNDER AGE THAT WE MIGHT BE ABLE TO ORDER A REMOVAL OF CONDITIONS, " BUT HE WAS NOT SURE" BUT HE WE CAN GET AN ORDER OF REMOVAL OF CONDITIONS THEN THE 10 YEARS WOULD HELP BECAUSE ANYONE THAT HAS BEEN HERE 10 OR MORE YEAR IS ABLE TO APPLIES FOR A WAVIER BUT IT IS ALSO HARD TO GET BECAUSE YOU HAVE TO SHOW EXTREME HARD SHIP! "BUT TO ME I DON'T NO IF THIS LAWYER IS A GOOD ONE BECAUSE HE SAID LET ME DO SOME TALKING WITH SOME OF MY LAWYER FRIENDS THAT'S IN MY GROUP THAT I HAVE CALLED AILA.ORG WHICH THIS IS WHERE I FOUND HIM!!!! I TELL YOU I LET HIS OFFICE A LITTLE SCARED AND WITH MY MIND THINKING ABOUT WHAT JUST HAPPENED!

IF ANY ONE HAS GONE THUR SOME THING LIKE THIS TELL ME ABOUT IF PLEASE!!!!

I know that when we went and spoke to a lawyer about trying to fix my husbands papers, one thing that my lawyer said was due to the law as it is now, it is difficult to adjust your staus if you never had status. Which means in order to adjust his status (apply for his papers) he would need to have had status - he came in on a visa and let it expire, etc. - otherwise it is very difficult. It isnt impossible, but difficult.

It is a bit more involved than the way that I said it, but that is it in a nutshell.

Well it sounds like your husband's case is complicated, but i'm sure it can be resolved (but sometimes that means your family moving to Honduras for 10 years). I would advise you to hold off a little on this process if you can because Obama is promising a immigration reform. He said he would have an immigration reform passed within the first year but it will probably be during the 2nd or 3rd. Obama says he doesn't want to separate families. Hopefully he goes through with his promise. Immigration lawyers on Univision are recommending immigrants to stay out of trouble and wait it out a little to see what the reform will be like. All i know is that having faith in God is the best way to deal with all this because He understands the unjustness of some laws and I am sure it will work out for the best.

yes i no i all ways have faith in god! but my husband says to have more faith he is a church guy you no one that has to been in everything that has to do with curch thats him! well i have seen that if we are looking at a ban it would only be for 5 years yeah 5 but quest # would i move there? dont have that anwser yet!

Oh so you all are only looking at a 5 year ban? Has the law changed or is it specific to your case? Because when I talked to a lawyer last year he said it was either you get approved within the first few months or it is 10 years. Five years doesnt sound too bad compared to 10 so if they changed the law that would be good. Yeah it would be a big change to have to move to Honduras but Im sure you could do it. The thing that would bother me the most is being away from my family. But reading these blogs about how people are moving there and their experiences is great! At least we can get a heads up of what it would be like~

yeah i no well the reason why it would only been a 5 year ban is because to did not appear in court so that is a 5 year band. And you see i have been allready to honduras and i went to a little town witch if you compare the country form the city well i went to the country and i was only 25 min for the city( la ceiba) but i could not live there for 5 years but we have been thinking anout moving there but not sure he dose not want to go and live there with out being able to come back but we will have to think hard about our what is best because i also told him ok my son is 5 if you go no then at the time 10 or 11 years old is when he needs you more!!!!

but still we will see

Hi! I just stumbled across your blog while looking up Honduras info. The exact same thing happened with us! My husband was given a paper when he came in blah blah blah They never explain this stuff very well right :) Anyways we applied for his papers from Honduras and they were denied so we came to Costa Rica. After four years we are ready and pretty excited to go back! Just wondering if you were still in the States or in Honduras. I would love to find some other American women to hang out with while I am there!
